DMCA Policy
1. Our commitment to copyright
{{LEGAL_ENTITY}}, the operator of Tely, respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. Tely is a social tracking service for movies and TV shows; it does not host, stream, or distribute copyrighted video content. Users may post text reviews, ratings, and curated lists referencing publicly available content metadata.
If you believe content on Tely infringes your copyright, you may submit a takedown notice following the procedure below. Tely will respond to valid notices promptly.
2. How to submit a takedown notice
To be valid under 17 U.S.C. § 512(c)(3), your notice must include all of the following:
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work you claim has been infringed. If multiple works are covered by a single notice, provide a representative list.
- Identification of the allegedly infringing material and enough information to locate it on Tely — for example, a direct URL to the post, the username of the account that posted it, and a description of where on the page the infringing content appears.
- Your contact information: name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.
Incomplete notices cannot be processed. Knowingly submitting a false notice may result in liability for damages under 17 U.S.C. § 512(f).
3. Where to send your notice

4. What happens after we receive your notice
Upon receiving a valid takedown notice, we will:
- Expeditiously remove or disable access to the allegedly infringing material.
- Notify the user who posted the content that it has been removed.
- Provide the user with a copy of your notice (from which your personal contact information may be visible) so they may exercise their counter-notice rights. By submitting a notice, you consent to this disclosure.
5. Counter-notice procedure
If content you posted was removed in response to a DMCA notice and you believe the removal was made in error or based on misidentification of your content, you may submit a counter-notice under 17 U.S.C. § 512(g)(3).
A valid counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal (e.g., the URL).
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, mailing address, and telephone number.
- A statement consenting to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the US, any judicial district in which Tely may be found), and that you will accept service of process from the original complainant.
Send counter-notices to the Designated Agent listed in Section 3.
6. Restoration of removed content
If we receive a valid counter-notice, we will forward it to the original complainant and inform them that we may restore the removed content in 10–14 business days unless the complainant notifies us that they have filed a court action seeking an order to restrain the alleged infringement. If no such action is filed in that window, we may, at our discretion, restore the material.
7. Repeat-infringer policy
In appropriate circumstances, Tely will terminate or suspend the accounts of users who are repeat infringers of intellectual property rights. A "repeat infringer" is any user who has had content removed in response to multiple valid DMCA takedown notices, or who has otherwise been shown to infringe third-party copyrights on multiple occasions.
8. Misrepresentation warning
Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages, including costs and attorneys' fees, incurred by the alleged infringer, the copyright owner, or Tely.

For trademark, trade dress, or other intellectual property concerns not covered by this DMCA procedure, please contact us at legal@telyapp.com with a description of the alleged infringement and the relevant evidence. We will review your complaint and respond as appropriate.
